Folkestone man wins bail appeal

October 25th, 2012

A Folkestone man charged with breaching his bail conditions has won his appeal on Friday. 67 year old John Chapman, who is accused of harassing his 84 year old neighbour, successfully appealed against the court’s decision to deny him bail.

Mr.Chapman had been accused of breaching his bail conditions by contacting his neighbour on two occasions. But new evidence has suggested that this accusation was false.

The defence lawyer presented CCTV footage and photographs of the property, showing that there was only one way in and out of Mr.Chapman’s home. This crossed paths with the entrance of his neighbour, making it very difficult for him not to avoid contact with her.

He had also been accused of using aggressive behaviour while driving past her in a car. But the court heard evidence that Mr.Chapman was not in Folkestone on this day.

Mr.Chapman’s new bail address is in Hawkinge. His family, who joined him in the court room, looked visibly relieved at the verdict. He will reappear in court in November to face the original charge of harassment without violence.
